Marialyn Barnard was appointed Justice of the Texas Fourth Court of Appeals on January 1, 2009. She was elected as Justice in 2010 and re-elected to a six-year term in 2012.  She has been a judge for nine years and has authored over a thousand civil and criminal opinions. Prior to her judicial years, she was an experienced attorney with a broad base of legal experience in state and federal courts.  At the time of her appointment, she was in private practice with the Prichard Hawkins McFarland & Young LLP law firm representing clients in civil litigation, multi-district litigation, and appeals.

Justice Barnard’s early legal career included working for several judges. During law school, she was an intern at the Texas Supreme Court for Former Justice John Cornyn and at the Texas Court of Criminal Appeals for Judge Charlie Baird.

In 1995, Justice Barnard was appointed by United States Attorney General Janet Reno to serve as Assistant United States Attorney in the Western District of Texas, United States Department of Justice.  She handled various cases including complex civil litigation cases. Several cases were parallel proceedings involving civil and criminal issues.

From 1999 to 2005 Justice Barnard was a corporate counsel and director of business intelligence for CPS Energy in San Antonio, Texas and a managing director of Forensic Litigation Services for KPMG. At KPMG she worked on mergers and acquisitions, compliance, and employee issues for U.S. and international corporations, companies, and partnerships.

Justice Barnard, as a former public school teacher, has also served as Director on the Firstmark Credit Union Board, originally the San Antonio Teacher’s Credit Union.  She has served as board member on the San Antonio Greater Chamber Board and on the San Antonio Women’s Chamber of Commerce Board. Justice Barnard has also served on the supervisory committee for the Academy of Creative Education (ACE) for the Northeast Independent School District in San Antonio working with high risk students to prevent them from becoming high school dropouts.

Justice Barnard is married to Gary Barnard, PhD. psychologist in private practice. They have two adult children and two very precious grandchildren.  Justice Barnard is a very involved and proud grandmother. The Barnard’s daughter, mother of their grandchildren, is Major Brandi Barnard King a U.S. Air Force Reserve C-5 pilot at Lackland A.F.B. married to Lt. Col. Dan King also a pilot.  The Barnard’s son, Joshua Barnard is an account executive in healthcare software and financing and, he is married to Dr. Kaessee Brown Barnard, OB-GYN. Former United States Air Force Major.
